Notify renters/lessees
If the decedent owned rental property, it is the executor’s responsibility to oversee the continued administration of the property. Remember that as executor, you may hire a professional to help if you do not have the time or skill to take on this responsibility.
Often, renters and lessees have questions about their status after the death of the property owner. They might want to know if the beneficiaries who receive the property plan to allow them to continue renting or leasing. Unfortunately, you are not able to provide that information.
At this point you also should not put them in touch with the beneficiaries listed in the will because you do not truly know who will receive any asset until the final debts are paid and final distribution is made. There are likely legal protections for renters and lessees regarding the required length of notification they must have before any lease is terminated. You can work with the estate’s attorney to determine what the requirement is and communicate this to the renter/lessee.
